1. Definitions
In these Terms and Conditions, the following words carry the meanings set out here:
- "Kampong Counsel", "we", "us", "our" — Kampong Counsel Pte. Ltd., a company incorporated in Singapore with its principal office at 82 Cecil Street, #15-04, Singapore 069541.
- "Course" — any educational programme offered by Kampong Counsel, including but not limited to the three courses described on our website at kampongc.biz.
- "Learner" or "you" — any individual who enquires about or enrols in a Course.
- "Content" — all course materials, worksheets, templates, reading lists, and other materials provided as part of a Course.
- "Agreement" — these Terms and Conditions, together with our Privacy Policy.
2. Acceptance of Terms
By submitting an enquiry through our website, enrolling in a Course, or accessing Course materials, you confirm that you have read and understood these Terms and that you agree to be bound by them. If you do not agree, please do not submit an enquiry or enrol in a Course.
You must be at least 18 years of age to enrol in a Course. By proceeding with enrolment, you confirm that you meet this requirement and have the legal capacity to enter into this Agreement.
3. Service Description
Kampong Counsel provides educational courses on estate planning, legacy, and related family matters as they apply in Singapore. Our Courses are educational in nature only. They do not constitute legal advice, financial advice, or professional counsel of any kind. Course materials explain how relevant Singapore legal frameworks operate; they do not produce legal documents on behalf of learners and do not establish a solicitor-client or advisor-client relationship.
Our Courses are available to residents of Singapore and to individuals who wish to understand Singapore estate law. We do not advise on estate matters in other jurisdictions.
4. Enrolment and Account
Enrolment is confirmed when payment has been received and a confirmation email has been sent to the address provided. Each enrolment covers access for a single individual. Course materials may not be shared, forwarded, or reproduced for others without our prior written consent.
You are responsible for maintaining the security of any login credentials provided and for all activity that occurs through your access.
5. Payment
Course fees are as published on our website at the time of enrolment and are stated in Singapore Dollars (SGD). Payment is due in full at the time of enrolment. We do not offer instalment arrangements unless specifically agreed in writing.
Payment is processed by a third-party payment provider. By proceeding with payment, you agree to the terms of that provider. Kampong Counsel does not store credit or debit card details.
6. Refund Policy
If you request a refund within seven days of your enrolment date and have not accessed more than the first week's materials, we will refund your course fee in full. Requests should be sent to [email protected].
After the seven-day period, or if more than the first week's materials have been accessed, course fees are not refundable. We believe this is fair given that the materials are immediately available in full on enrolment.
7. Access to Course Materials
Once enrolled, you will have access to course materials for as long as Kampong Counsel continues to offer the relevant Course. We do not impose a time limit on your access. If we discontinue a Course, we will give at least 60 days' notice and provide you with a downloadable copy of all materials to which you are entitled.
We review course content annually and may update materials to reflect changes in Singapore law. Updated materials will be made available to all enrolled learners at no additional cost.
8. Intellectual Property
All Content provided as part of our Courses is the intellectual property of Kampong Counsel or its licensors. Your enrolment grants you a personal, non-exclusive, non-transferable licence to access and use the Content for your own private, non-commercial purposes.
You may not reproduce, distribute, republish, upload, post, display, or create derivative works from any Content without our prior written permission. This applies to all materials, including worksheets and templates provided as part of a Course.
9. User Conduct
You agree not to:
- Share course access credentials with others;
- Reproduce or distribute course materials for commercial purposes;
- Use course materials in any way that misrepresents their source or nature;
- Interfere with the operation of our website or systems;
- Use our services in any manner that violates Singapore law or the rights of others.
10. Disclaimer
Our Courses are provided for educational purposes only. Nothing in our Course materials or communications constitutes legal advice, financial advice, tax advice, or professional advice of any kind. We make no representation that any particular course of action is suitable for your individual circumstances.
We have taken care to ensure that the information in our materials is accurate as at the date of its most recent review. However, laws and regulations change, and we cannot accept liability for any loss arising from reliance on course materials that have since become outdated.
11. Limitation of Liability
To the extent permitted by Singapore law, Kampong Counsel's total liability to you in connection with any Course or these Terms shall not exceed the amount you paid for the relevant Course. We shall not be liable for any indirect, consequential, or special losses, including loss of opportunity, loss of income, or loss arising from decisions made on the basis of course materials.
Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
12. Termination
We may suspend or terminate your access to course materials if you breach these Terms. In such circumstances, no refund will be provided.
You may discontinue your use of course materials at any time. Refunds remain subject to the refund policy set out in Section 6.
13. Dispute Resolution
If you have a concern about our services, please write to us at [email protected] in the first instance. We will make reasonable efforts to resolve any dispute informally within 30 days of receiving your written communication.
If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Singapore. These Terms are governed by the laws of Singapore.
14. General
These Terms constitute the entire agreement between you and Kampong Counsel in relation to your enrolment in a Course and supersede all prior discussions and representations. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force. Our failure to enforce any right does not constitute a waiver of that right.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a revised date. If you are currently enrolled in a Course, we will notify you by email of any material changes at least 14 days before they take effect. Continued use of course materials after that date constitutes acceptance of the updated Terms.
